This privacy policy (“Policy”) describes how Biteback (“Biteback,” “we,” “our,” or “us”) collects, uses, discloses, and protects personal data in accordance with the Personal Data Protection Act 2012 (No. 26 of 2012) of Singapore (“PDPA”), as well as other applicable data protection laws across Asia where we operate. It also explains your rights and choices regarding your personal data.

This Policy governs your use of the Biteback mobile application (“Application”), the biteback.co website (collectively, “Website”), and any other online services owned and operated by Biteback that link to this Policy (“Services”). (Together, the Website, Application, and Services are the “Biteback Program”).

1. Applicability

Data protection law distinguishes between organizations that determine the purposes and means of processing (“data controllers” or “organizations”) and those that process on behalf of others (“data intermediaries” or “processors”). This Policy applies where we act as a data controller/organization. Where we process data on behalf of a business partner or merchant, that partner’s privacy policy will apply.

2. What Personal Data Do We Collect?

(a) Consent

1. Eligibility

2. Your Account

5. Credits, Promotions & Referrals

  • Credits: Biteback may issue credits (such as “House Accounts” or other stored value) that can be redeemed with participating merchants. Credits are not transferable, not exchangeable for cash, and may be subject to additional terms.

  • Promotions: From time to time, Biteback may run promotions, discounts, or offers. These are subject to specific terms and may be modified, suspended, or withdrawn at any time without notice.

  • Referrals: If you participate in our referral program, you may earn rewards or credits by referring new users, subject to applicable terms. Biteback reserves the right to withhold or revoke referral rewards in cases of suspected fraud, abuse, or violation of these Terms.

  • Expiry: Credits, rewards, and promotional offers may expire if not used within the validity period stated in the offer or under applicable law.

6. Intellectual Property

  • All content, trademarks, and materials on the Services are owned by or licensed to Biteback and are protected under applicable intellectual property laws.

  • You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

7. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and disclose your personal data in compliance with Singapore’s Personal Data Protection Act (PDPA) and other applicable laws.

8. Disclaimer of Warranties

To the fullest extent permitted by law:

  • Biteback shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

  • Biteback’s total liability for any claim shall not exceed the amount you paid, if any, for use of the Services in the 12 months preceding the claim.

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have breached these Terms or applicable law.

11. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Singapore, without regard to conflict-of-law rules.

  • Any dispute shall first be attempted to be resolved amicably. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Singapore.

12. Changes to These Terms

We may update these Terms from time to time. Updates will take effect when posted on our Website or Application with a revised effective date. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

Merchant Disclaimer & Partner Terms.

These Partner Terms (“Terms”) apply to merchants, restaurants, and partners (“Merchant”, “you”) who participate in the Biteback program (“Program”). By enrolling in the Program, you agree to the following:

1. Program Participation

  • You agree to honor valid Biteback credits, vouchers, and promotions presented by users in accordance with the Program rules.

  • Biteback reserves the right to modify or discontinue the Program at any time.

2. Payments & Settlements

  • Biteback will remit payments for credits redeemed at your establishment in accordance with the agreed settlement terms.

  • You acknowledge that users may receive credits or promotions funded by Biteback or third parties, and you agree to accept such credits as valid payment.

3. No Liability for Users

  • Biteback is not responsible for the conduct, behavior, or actions of users, including misuse of credits or promotions.

  • You remain solely responsible for the quality, safety, and legality of your goods and services.

4. Intellectual Property

  • Biteback may use your trade name, logo, and related materials for promotional purposes to indicate your participation in the Program.

  • You grant Biteback a non-exclusive, royalty-free license to use such materials during the term of your participation.

5. Compliance with Law

  • You agree to comply with all applicable laws and regulations, including consumer protection, health, and safety standards.

  • You are responsible for any permits, licenses, or approvals required to operate your business.

6. Limitation of Liability

  • To the maximum extent permitted by law, Biteback shall not be liable for any indirect, incidental, or consequential damages arising from your participation in the Program.

  • Biteback’s total liability to you shall not exceed the total fees paid to you for credit redemptions in the six (6) months preceding the claim.

7. Governing Law

These Terms are governed by the laws of Singapore, and any disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.
